where the defence of self defence is made out then the act done in self defence is not unlawful, the homicide is not culpable and the accused must be acquitted : r. v. baker (1988), 45 c.c.c. (3d) 368 (b.c.c.a.)
there is also case law that states in the matter of self defence ; the threat does not have to be imminent but can be implied, and that in self defence i have the right to use as much force as necessary up to, and including murder, to prevent an attack ; I'm looking for that case law ;
Mr president i have an enemy combatant, as you state in custody for murder of an American soldier, by throwing a hand grenade out from his place of hiding if my memory is correct ; i request with these facts before you, that this boy be set free and returned to his home ; Mr president in my opinion the constitution of the united states does not apply in Afghanistan or in Iraq ; your judicial powers are not that wide spread in a matter of war, or for that matter in peace either ; you are an invading army, and that there can be no less stated than that ; i believe you are in violation of international law under war measures acts to try persons under your authority of judicial powers to acts of murder in a combat scenario ; you can not change the fact to cover your actions as to remove the word invading force to one were we are here to help to establish a foot hold under fear to set a stage towards a ground invasion into Iran ; i know what your trying and what your up to ; yes the production of plutonium is a concern ; but your not going to use that as a prelude to cause an invasion on Iran and i will fight you with and to my last breath ; your intentions are deceit ; as but your intentions of deceit to go into Iraq were ; Saddam had no weapons of mass destruction then or now ; you sir were a lier then and i believe you not now ;
